Abstract

What determines the regulation of chemical substances of very high concern under the European regulation on the Registration, Evaluation, Authorization, and Restriction of Chemicals, REACH? Empirical research has shown that the most important factor in whether a substance is regulated is whether it is being produced or imported into the European Economic Area, with the regulators less likely to place a substance on the list if it is currently being produced or imported in the EEA. In this paper, I model the incentives created by the regulatory procedures and I develop a series of testable hypothesis which I confirm with data. My results bring light on when and how national interests affect the decision on what to regulate, and on the role of EU countries, the executive agency and the EU Commission shaping the regulation of substances of very high concern.
